“498A में acquittal हो गया… अब तो सब खत्म?”
यह assumption एक Delhi matrimonial case में husband और his parents के लिए sufficient नहीं था.
In Dinesh Kumar Sheoran & Ors. v. Mohini, decided by the Delhi High Court on 25 May 2026, the wife had approached the Crime Against Women (CAW) Cell on 02.11.2015.
That complaint resulted in FIR No. 40/2016, registered at P.S. Palam Village, South-West Delhi, under Sections 498A/406/34 IPC.
But there was another proceeding.
The wife had also initiated proceedings under the Protection of Women from Domestic Violence Act on 14.01.2016.
The husband and his parents were eventually acquitted in the criminal case on 26.11.2024, as the prosecution failed to establish the criminal allegations beyond reasonable doubt.
Then came the important question:
“जब 498A/406 में acquittal हो गया, तो same matrimonial allegations वाला DV case क्यों चले?”
The Delhi High Court did not treat the criminal acquittal as an automatic end to the DV proceedings.
Why?
Because criminal proceedings and proceedings under the DV Act are legally distinct, with different evidentiary standards and purposes.
So remember this distinction:
498A acquittal ≠ automatic closure of DV proceedings.
This is a critical point for husbands, parents and other family members facing a CAW Cell Delhi complaint, CAW Cell Nanakpura matter, CAW Cell Seema Puri complaint, 498A/406 allegations or parallel DV proceedings in Delhi NCR.
एक proceeding में relief मिलना जरूरी नहीं कि दूसरी proceeding भी अपने आप खत्म हो जाए।
The Delhi High Court dismissed the petition seeking interference with the pending DV proceedings, leaving the parties' respective rights and contentions open before the appropriate court.
The real practical warning
If your family is already facing a matrimonial complaint, don't look at the FIR alone.
Check:
CAW Cell complaint
FIR / criminal case
DV proceedings
Maintenance proceedings
Connected family/property allegations
Orders already passed by different courts
Each proceeding may require a separate legal and procedural strategy.
